HALP Terms of Service

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms or services, you agree to be bound by these Terms.

For Advertisers, these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement prevails.

These Terms apply to all HALP platforms, including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications, and any related websites or services within our network.

By accessing or using our services you acknowledge that you have read and understood these Terms, agree to be bound by them and our Privacy Policy, represent that you are at least 18 years of age, and represent that you have the authority to enter into this agreement.

We reserve the right to modify these Terms at any time. When we make changes we update the "Last Updated" date, notify registered users via email, prominently display material changes, and changes take effect immediately upon posting (or as otherwise specified).

2. Description of Services

HALP operates specialised property discovery and business directory platforms — house and land package listings, off-the-plan properties, new development project details, boutique and luxury property showcases, school zone integration, property calculators and tools, mortgage broker connections, and property market insights.

Business directory services include professional business listings (freemium model), enhanced visibility for premium subscribers, lead generation and inquiry management, business profile management, and multi-platform advertising reach.

Nature of service — HALP is an information and advertising platform. We facilitate connections between property seekers and property providers, aggregate and display property and business information, and provide research tools. We are not a real estate agent, developer, builder or financial advisor.

Lead routing — property listing inquiries go directly to the listing agent, developer or builder. HALP does not store, process or access those inquiries. Contact Us / Join Us / Advertise With Us inquiries are managed by HALP per our Privacy Policy.

No agency relationship — HALP does not act as your agent, provide property/financial/legal/tax advice, or bind you to any transaction.

Services are provided "as is" and "as available". We may modify, suspend or discontinue services at any time. Scheduled maintenance may cause temporary interruptions. Platform infrastructure includes AWS hosting and backups, Synergywholesale domain hosting, Google Workspace, Stripe payments, Pipedrive and ActiveCampaign CRMs, and Zapier for automation.

3. User Accounts and Registration

To access certain features you may need to create an account. You must provide accurate, current and complete information; maintain the confidentiality of your credentials; be at least 18 years of age; only create one account per person; and provide a valid ABN/ACN for business accounts.

You are responsible for all activities that occur under your account and must notify us immediately of any unauthorised access.

We may suspend or terminate your account if you breach these Terms, provide false information, use the account for fraudulent or illegal activities, fail to pay applicable fees, or remain inactive for an extended period. You may terminate your account at any time by contacting support@halp.com.au.

4. User Conduct and Prohibited Activities

You must comply with all applicable laws, use services only for lawful purposes, provide accurate information, respect intellectual property, and act in good faith when contacting property providers.

You must not misuse the platform (bots or scrapers without authorisation, interference with functionality, unauthorised access attempts, reverse engineering, circumventing security), post harmful content (false or deceptive information, viruses or malware, spam, phishing, impersonation), engage in illegal activities (breaching laws, IP infringement, fraud, money laundering), harass or abuse other users, or misuse the platform commercially (reselling services, aggregating or scraping listings, creating multiple accounts to circumvent restrictions).

Violations may result in immediate account suspension or termination, removal of content, legal action, reporting to authorities, and permanent bans.

5. Property Listings and Information

Property listings are provided and owned by developers, builders, agents, project marketers and third-party data providers. HALP does not own or control third-party listings, verify all listing information, endorse any provider, or guarantee availability or pricing.

Property information may change without notice; prices, availability and specifications are subject to change; images and renderings may not reflect final product; land sizes are approximate; school zone information is provided for reference only.

Important — always verify critical information directly with the property provider before making decisions.

School zone data is sourced from government databases and third-party providers, provided "as is" for general reference, and subject to change. Always verify school catchment zones directly with the relevant education department and individual schools. Enrolment is not guaranteed by living in a catchment zone.

6. Business Directory Listings

To advertise in our business directory you must hold a valid ABN or ACN; be a legitimate operating business; comply with all applicable business and advertising laws; provide accurate business information; and hold necessary licenses.

Business listings must accurately describe your services, include current contact information, use your own business name and logo, comply with Australian Consumer Law, and not contain misleading or deceptive claims.

Free listings provide a basic directory presence. Premium subscriptions provide enhanced visibility and features, require monthly or annual payment, auto-renew unless cancelled, and are subject to separate subscription terms.

We may remove or suspend business listings for breach of these Terms, credible complaints, failure to pay, unlicensed operation, or prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing for subscriptions, listings, promotions and add-ons is as displayed on our website and/or at checkout, or in the applicable Listing Agreement. Pricing is subject to change with 30 days notice. All fees are in Australian Dollars (AUD) — prices displayed exclusive of GST unless otherwise stated, GST added at checkout where applicable. Unless we state otherwise at checkout, standard payment processing fees are included in the advertised price.

Payments are processed via Stripe (PCI-DSS Level 1 certified). We do not store complete credit card numbers on our servers.

Subscriptions auto-renew unless cancelled. You may cancel any time before your next billing date — cancellation takes effect at the end of the current billing period. No refunds for voluntary cancellations. Pro-rata refunds for technical issues preventing service access, processed within 14 business days.

If payment fails we will attempt to process payment multiple times. Your account may be suspended after 7 days and your listing removed after 14 days. You remain liable for unpaid fees and collection fees may be added.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us — including "HALP", "House And Land Packages" and "Boutique Developments" trademarks, website design, code and algorithms, text, graphics, images, videos, data compilations and school zone aggregations.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, modify or commercially use our content without permission.

When you submit content to our platforms (reviews, testimonials, forum posts) you retain ownership and grant us a worldwide, royalty-free licence to use, reproduce, modify and display your content.

If you believe content on our platform infringes your copyright, contact legal@halp.com.au with details and proof of ownership.

9. Disclaimers and Limitations

No professional advice — HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Calculators provide estimates only.

Third-party relationships — HALP facilitates connections but does not control the conduct of third parties or guarantee the quality of third-party services.

Data accuracy — information may contain errors or omissions. Property, school and market data are for reference only. We are not liable for decisions based on our information.

Service availability — we do not guarantee continuous access, error-free operation, or absence of viruses. We are not responsible for failures of third-party services (AWS, Stripe, etc).

10. Limitation of Liability

To the maximum extent permitted by law HALP and its directors, officers, employees and agents are not liable for direct damages (loss of profits, revenue, data, business opportunities, cost of substitute services) or indirect damages (consequential, incidental, special or punitive damages) arising from your use or inability to use our services, errors in content, third-party conduct, unauthorised account access, or property transactions you enter into.

Where liability cannot be excluded by law, our total liability is limited to $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid us in the prior 12 months.

Nothing in these Terms excludes rights or remedies under the Australian Consumer Law that cannot be excluded. Where the ACL applies, our liability for breach of consumer guarantees is limited (at our option) to re-supplying the services or paying the cost of having services re-supplied.

You agree to indemnify HALP from claims arising from your breach of these Terms, violation of law or third-party rights, use of our services, content you submit, or interactions with other users or third parties.

11. Dispute Resolution

Before initiating legal proceedings you agree to contact legal@halp.com.au with details of your dispute and allow 30 days to investigate and respond.

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.

For disputes not resolved informally, either party may request arbitration under Australian Dispute Resolution Association (ADRA) rules in Sydney, NSW. To the extent permitted by law, disputes are resolved on an individual basis and class actions are waived.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HALP. If any provision is found invalid it will be limited or eliminated to the minimum extent necessary. Our failure to enforce any provision does not waive our right to enforce it later. You may not assign these Terms without our written consent — we may assign to any affiliate or in connection with a merger, acquisition or sale of assets.

13. Special Terms for Specific Services

Mortgage calculators provide estimates only, use average interest rates and standard assumptions, may not account for all fees, do not consider your personal financial situation, and should not replace professional financial advice.

School zone data is aggregated from public government databases, provided "as is" without warranty of accuracy, and subject to change without notice. School zone boundaries change frequently — always verify with the relevant state education department, the specific school, and local council. Enrolment is not guaranteed.

Property alerts — by subscribing you consent to receive emails and SMS notifications. Frequency depends on market activity and your search criteria specificity.

Home loan referrals — we may receive a referral fee or commission. Brokers are independent third parties. We do not guarantee loan approval. You are free to use any broker or lender.

15. Property Listing Inquiry Flow

Important — direct to advertiser routing. When you submit a property listing inquiry your information is sent directly to the listing agent/developer. HALP does not store, read or process your inquiry (this applies to property listing inquiry forms; Contact Us, Join Us and Advertise With Us are handled by HALP as described above). The advertiser becomes responsible for your information and their privacy policy governs their use.

HALP provides the technology infrastructure for inquiry submission, routes inquiries in real time to the advertiser, and does not store inquiry content or personal information. HALP does not access or read inquiry content, share inquiries with other parties, control how advertisers use your information, or guarantee advertiser response times.

By using any inquiry form you acknowledge and agree that property listing inquiries go directly to advertisers, you understand the advertiser will receive your contact information, and you should review advertiser privacy policies before submitting.

16. Definitions

Platform — all HALP websites, mobile applications and related services. User — any person or entity that accesses or uses our services. Content — all information, text, images, data, software and materials on our platforms. Property Provider — developers, builders, real estate agents and other entities listing properties. Advertiser — professionals and businesses advertising in our directory. Personal Information — has the meaning given in the Privacy Act 1988. Listing — any property advertisement, business directory entry or content posted on our platforms.
